الأحکام الفقهية المستنبطة من أحاديث الأحکام بَاب (مَا جَاءَ فِي قِرَاءَةِ الْمَأْمُومِ وَإِنْصَاتِهِ إذَا سَمِعَ إمَامَهُ) من کتاب منتقى الأخبار، نموذجًا. دراسة تأصيلية.

تناولتُ في هذه البحث جمع ودراسة الأحکام الفقهية المستنبطة من أحاديث الأحکام من بَاب (مَا جَاءَ فِي قِرَاءَةِ الْمَأْمُومِ وَإِنْصَاتِهِ إذَا سَمِعَ إمَامَهُ)، وهذا الموضوع من الأهمية بمکان؛ لتعلقه بمعرفة أحکام قِرَاءَةِ الْمَأْمُومِ وَإِنْصَاتِهِ إذَا سَمِعَ إمَامَهُ في الصلاة الواردة في الأحاديث النبوية الشريفة، ولأنه بيان لما أولاه النبي r من عناية خاصة بأحکام الصلاة، سيترک أثرًا عظيمًا في نفوس عامة الناس، ويجعلهم أشد تقديرًا للصلاة، وحرصًا عليها.
وقد خَلَصْتُ في نهاية البحث إلى ظهور عناية الفقهاء بأحاديث الأحکام، وتأثير استدلاهم بها على الخلاف في المسائل الفقهية، وکذلک أهمية دراسة أسباب اختلاف الفقهاء في الأحکام المستدل عليها من أحاديث الأحکام، ودراسة العلاقة بين أحاديث الأحکام وبين القواعد الأصولية والفقهية، ومدى تأثير ذلک على الحکم الفقهي الفرعي، وکذلک الاجتهاد في ربط النوازل الفقهية بأحاديث الأحکام تفقهًا، واستدلالًا، وبيان أثر الاستدلال بالحديث النبوي وصحته على قوة الخلاف وضعفه بين العلماء.
 
 
 
 
 
 
 
 
 
 
 
 
 
Abstract
The thesis deals with assembling and study of the jurisprudence rulings inferred from the rulings of Hadith sayings of the part, " the loud reciting on the part of the praying person behind Imam and his obligatory listening on hearing the reciting of Imam".
This topic is so important as it is concerned with the rulings of the prayers mentioned in the Honorable Hadith sayings. This will have a great impact on people's souls and make them more appreciating to prayers and careful about them.
. At the end of the search, I concluded that Jurisprudence Faqeehs gave more attention towards the rulings Hadith and the influence of quoting them by Faqeeh in terms of the different opinions as for the jurisprudence queries I addition to the importance of the study of the reasons behind the arguments over the rulings inferred by the rulings Hadith and to what extend the judgments of the Faqeeh affects the secondary jurisprudence rulings in addition to exerting efforts to link the new jurisprudence rulings with the rulings Hadith and to show the influence of inferring of the prophet's sayings on the prophet's saying and its validity in virtue of the scholar's controversies as for its weak attributing reporters
