صور من الاعتداء على الإنسان وأحکامها في الفقه الإسلامي

هدف البحث عرض بعض صور الاعتداء على جسد الإنسان وبيان رؤية الفقه الإسلامي لها، واعتمد البحث على المنهج الاستنباطي، وجاء مکوناً من إطار عام شمل المقدمة والمشکلة والأسئلة والأهداف والأهمية والمنهج والحدود والدراسات السابقة، ثم أربعة مباحث موزعة لمطالب على النحو التالي: المبحث الأول: التعريف بجسم الإنسان وأبرز حقوقه، وشمل المطالب التالية: المطلب الأول: التعريف بجسم الإنسان، المطلب الثاني: أبرز الحقوق المرتبطة بجسم الإنسان، المطلب الثالث: مفهوم الاعتداء على الإنسان، المبحث الثاني: الاعتداء على جسم الإنسان بالتشريح (صوره وأحکامه)، وشمل المطالب التالية: المطلب الأول: التعريف بتشريح  جسد الإنسان، المطلب الثاني: أقسام التشريح وحکمها في الفقه الإسلامي، المطلب الثالث: ضوابـــط تشريـــح بـــدن الميــت، المبحث الثالث: الاعتداء على جسم الإنسان عن طريق القتل بالتسبب، وشمل المطالب التالية: المطلب الأول: تعريف القتل بالتسبب، المطلب الثاني: أقوال العلماء في حکم القتل بالتسبب، المطلب الثالث: صور القتل بالتسبب وأقوال العلماء فيها، المبحث الرابع: بعض صور التداوي التي تشمل اعتداء على جسد الإنسان وحکمها، وشمل المطالب التالية: المطلب الأول: إزالة الأصبع الزائدة، المطلب الثاني: إزالة ما يشوه الجسم من عيوب وتشوهات تطرأ أعلى الجلد، المطلب الثالث: إعادة العضو المبتور بسبب حادث، المطلب الرابع: نقل عضو من شخص حي إلى شخص آخر، المطلب الخامس: قطع اليد المتآکلة
Forms of human abuse and its rulings in Islamic jurisprudence
Abstract:
The research aimed to present some forms of abuse on the human body and explain the Islamic jurisprudence vision of it. The research relied on the deductive method and consisted of a general framework that included the introduction, problem, questions, aims, importance, method, borders and previous studies, then four topics distributed to demands. The first topic entitled definition of the human body and its prominent rights, and it included the following demands: The first demand included definition of the human body, the second demand included the prominent rights related to the human body, and the third demand included the concept of abuse on human. The second topic entitled abuse on the human body by anatomy (its forms and provisions) included the following demands: The first demand included definition of the anatomy of the human body, the second demand included sections of anatomy and its rule in Islamic jurisprudence, the third demand included controls for the dissection of the dead body. The third topic included abuse on the human body through killing by causing, and included the following demands: The first demand: the definition of killing by cause, the second demand: the sayings of scholars concerning the ruling on killing by cause. The third demand: forms of killing by causing and sayings of the scholars about it. The fourth topic entitled  some forms of medication that include an attack on the human body and its rule, and included the following demands: the first demand included removal of the excess finger, the second demand included the removal of the body deformities that appear on top of the skin, the third demand included restoration of the amputated organ due to an accident, the fourth demand included transfer of a member from a living person to another person, and the fifth demand included cutting off the eroded hand.
